General Rental Conditions

1 – GENERAL

1.1 Baires Rentals (hereinafter called `The Agency´) arrange temporary business and holiday accommodation in Buenos Aires for international travellers and companies. All booking applications accepted by the agency are subject to these terms and conditions that are deemed to have been accepted in full by the hirer and all persons in the party.

1.2 The client acceptance of these conditions is acknowledged by making a booking or sending the agency a completed booking application. Payment of deposit or rental charge also indicates acceptance of these terms and conditions.

1.3 The agency has an inventory of elegant and spacious studio, one-bedroom, and two-bedroom furnished condominiums. Each apartment has been thoughtfully accessorized.
Included are all linens, towels and housewares. You have the privacy of your own residence and the comfort you are used to at home.

1.4 Most units may be booked for a minimum stay of one week, and a maximum period of six months, as asserted by local legislation. Nightly rates are occasionally available.

2 – COMPLETION OF AGREEMENTS

2.1 Before booking, you are kindly requested to contact Baires Rentals to confirm availability of the property you have chosen. Reservations shall be binding only if guaranteed by a non refundable deposit of 20% calculated on total rent.

2.2 Booking shall only be confirmed on receipt of payment of your booking deposit. Written confirmation will be issued by Baires Rentals by E-mail or fax. Group reservations require a written acceptance and confirmation.

2.3 The booking confirmation and rental agreement sent by the agency shall contain all relevant details for the stay in the booked apartment. To prevent misunderstandings, the tenant is required to thoroughly check the booked details and report incompleteness or inaccuracies within seven days after receipt of the booking confirmation.

2.4 For bookings with a lead-time of less than five days, payment of the deposit guaranteed by a major credit card will be required.

2.5 Group bookings are subject to the group contract terms. A group booking is any booking of 5 apartments and more, emanating from a single entity.

2.6 Reservations made by individuals under the age of 18 years at the time of booking are void.

3 – PAYMENT

3.1 The balance of rent must be paid upon arrival in cash money, not later than the first day of the rental period, or the first day of an extended period, whichever is applicable. Failure to pay the balance on arrival may cancel the contract and cause cancellation penalties, in accordance with paragraph 6 hereinafter.


3.2 Payments for additional services will be required on presentation of the invoice without delay.

3.3 The agency accepts Western Union cash transfers, direct bank transfers (deposits) made in the firm US bank account, Pay Pal web payments, and cash payments in US dollars or Euros. We do not accept cheques of any kind. Ask for other currencies.

3.4 Payments made by bank transfer must reach the agency´s account net of all bank charges. Please ask your bank to detail your name and invoice number clearly on the transfer. A copy of the transfer should then be sent or faxed to Baires Rentals .

3.5 Any receipt or bank transaction does not constitute by itself a binding reservation. Such a binding relationship arises only from issuance of a Booking Confirmation by the agency.

3.6 Payments must be clear of all bank charges, exchange rate variations, and any other deductions.

4 – RATES

4.1 The rental rates are given in United States Dollars, unless otherwise specified. The exact payment to be charged, as well as any administrative fee or extra, shall be clearly and explicitly detailed in the booking confirmation.

4.2 All the apartments are let fully furnished and equipped. The price of the rental includes the cost of all services and consumables (among them : electricity, heating, water and gas supply, limited phone calls, cable or satellite TV, linen and towels, welcome bathroom supplies, and weekly cleaning services).

4.3 Where applicable, a broadband internet connection is provided free of charge. However, the continuity of the service is not guaranteed. Neither the agency nor the owner can be held accountable for any loss of connection. If such a loss of connection does occur, the agency will endeavour to get reconnected as quickly as possible.

4.4 The rent includes every local tax at the prevailing Argentinean rate.

4.5 The price of the rental does not include the costs of additional services requested, and does not include any personal insurance cover. Baires Rentals recommends that the resident should take out relevant insurance coverage, for his regular luggage as well as for any valuable. Please refer to paragraph 14 below.

4.6 A fully refundable damage and key deposit shall be required to cover the cost of any eventual damage or breakage to the apartment and its contents. This guaranty or security deposit (deducted the repair or replacement cost of missing, broken or damaged objects), shall be returned upon departure. The deposit will be the equivalent of:

4.6.1 A week stay for any reservation of between one night to a month; or
4.6.2 A whole month stay for any reservation of over one month.

4.7 Baires Rentals administrative fee amounts USD 35. This fee shall be paid upon check-in in cash.

4.8 All prices are based on costs prevailing at the time of quotation and may be subject to change.

5 – FACILITIES AND SERVICES

5.1 All apartments are fully furnished to a high standard and include a kitchen fully equipped with appliances, cutlery, crockery, and kitchen utensils.

5.2 A cable or satellite TV, and a private phone number, are provided at all locations.

5.3 All linen and towels are included and changed once a week. Additional linen and towels can be provided on request.

5.4 A full inventory of equipment and utensils is placed in each apartment. It is the obligation of the resident to verify the completeness of the inventory and the state of repair and condition of all equipment and utensils upon arrival. In the event of discrepancies, the hirer shall report such discrepancies within four hours of arrival. If no discrepancy is reported, the resident is deemed to have accepted the inventory. Please note : No ítems should be removed from the apartment during your stay.

5.5 Many units offer complimentary amenities, detailed in the page of the specific property (among others : PC´s, a broadband internet connection, and many more features).

5.6 Some apartments feature exercise facilities and front desk/concierge.

5.7 Weekly maid service is a standard, for every stay of 10 days and longer. Cleaning services for shorter stays shall be performed on departure. Additional housekeeping services are available for a fee.

5.8 Pets are allowed in many locations. You are kindly requested to call for specifics as there might be fees associated with pet occupancy. Please refer to paragraph 12 below for broader information.

6 – OBLIGATIONS OF THE RESIDENT

6.1 The guest agrees to keep the property and all the fitments, furniture, effects, facilities, equipment and other contents in or on the property in the like state of repair, clean and tidy as at the commencement of the rental period. The resident is responsible for taking reasonable care of the apartment and its contents.

6.2 Except in the case of normal wear and tear, the hirer will be responsible for making good any damage or loss which occurs to the apartment or its contents, no matter this occurred due to negligence, willful damage, wanton misconduct, or irresponsible behaviour on the part of those occupying the apartment or their guests. Such damage must be reported, without delay, to the agency.

6.3 A final inventory and check of the apartment will be conducted on or before the resident's departure. Baires Rentals will charge a resident for any item of equipment or utensil missing from the inventory, and/or for any damage caused to the apartment.

6.4 Representatives of the agency have the right of access to the property at any time, with due regard to the convenience of the hirer, for the purpose of inspection of the property, and to carry out any essential repair or maintenance work.

6.5 Where explicitly specified in the apartment reference sheet, a no smoking policy prevails. Smoking is strictly forbidden in those apartments.

7 – CHANGES MADE BY THE AGENCY

7.1 While every effort is made to adhere to the apartment location stated in a booking, Baires Rentals reserve the right to supply an alternative apartment at any time until check-in.

7.2 In such an unlikely event, the variation will be communicated to the client in writing at once. On receiving notification, the client has forty-eight hours to communicate non-acceptance of the change described. If no such communication is received, the client is assumed to have accepted the variation. If communication of non-acceptance is received within forty-eight hours, the booking deposit will be fully returned to the client .

8 – CANCELLATION / NO SHOW POLICY

8.1 All notification of cancellation must be made in writing by E-mail or fax. The cancellation becomes effective the date of delivery to the agency.

8.2 When notification is received more than 21 days prior to the arrival date, all payments received from the client are refunded, less a USD 20 cancellation fee, which will be deducted from the booking deposit.

8.3 When notification is received within 21 days prior to the arrival date, the full booking deposit is forfeit.

8.4 Change of arrival or departure date, as well as an alteration in the apartment location originated by the client, may be treated as cancellation and re-booking.

8.5 The agency strongly recommends you to book accommodation only when your travel itinerary is firm and final, and to get a cancellation insurance coverage.

9 - MODIFICATION TO A RESERVATION

9.1 Subject to availability and at the discretion of the agency, the length of stay can be extended, although there will be no obligation to allocate the same apartment or to apply the same rate.

9.2 If the duration of the stay is to be shortened, the aplicable terms in paragraph 8.4 shall apply.

10 - NUMBER OF OCCUPANTS

10.1 Only persons listed on the Booking Form may occupy the apartment.

10.2 The apartment cannot be re-let / sublet to any other party without the written approval of Baires Rentals .

10.3 The number of persons permitted to occupy the apartment is limited to the number of beds available. Under no circumstances may more than the maximum number of persons specified in the apartment description occupy the unit, except by prior written agreement with the agency. The agency and / or the apartment owner reserve the right to refuse admittance to the apartment to the hirer and their party, if they are in breach of this condition.

10.4 Guests who disregard this requirement may risk losing their accommodation without refund of rental fees.

11 – CHECK-IN AND CHECK-OUT

11.1 All apartments are usually available for occupation after 2:00 p.m. on the day of arrival. Keys are made available right in the apartment site, at no extra cost during working hours (between 9:30 a.m. and 7:00 p.m.).

11.2 The team of the agency personally meets and greets every guest. Following a familiarisation tour of the apartment and the building, the arrival staff will be pleased to answer any questions regarding the neighborhood, Buenos Aires and Argentina.

11.3 All apartments must be vacated by 11:30 a.m. on the day of departure, and keys must usually be returned by 11:30 a.m. on that day. Arrangements can be made for return of keys on alternative days prior to the day of departure and after working hours, subject to prior arrangement.

11.4 Clients are kindly asked to notify the agency of the airline being flown, arrival/departure airports and scheduled time of landing/departure, to insure smooth reception and departure procedures.

11.5 If there is any delay in vacating the apartment beyond the check-out time, a full day´s rental, calculated as one seventh of the weekly applicable rate, is charged to the hirer.

12 - PETS

12.1 Baires Rentals understands how wonderful it is to share an apartment in Buenos Aires with your cherished pet. Regrettably, we have a limited number of rental properties that are pet friendly. Ask your reservation agent to inform you on your chosen property´s pet policy prior to making your reservation.

12.2 Note that owners that allow pet occupancy may ask for additional deep cleaning service and security deposit.

12.3 The client is liable for any infringement of the pet policy rules.

13 – TERMINATION

13.1 Baires Rentals has the right to terminate a booking at any time on the following grounds :

13.1.1 Mistreatment of the apartment or criminal activity on the part of those occupying the premises or their guests.
13.1.2 Loud, disruptive and unruly conduct causing disturbance to other residents or neighbours may be grounds for the guest's tenancy to be abruptly halted.

13.2 In the circumstances described thereof, the agency is not obliged to provide or locate alternative accommodation. The period of notice and the proportion of refund are at the discretion of Baires Rentals .

14 – LIABILITY AND INSURANCE

14.1 The apartment hire cost does not include any personal insurance cover of any kind. The client´s belongings are not covered by the property insurance. Neither Baires Rentals , nor its representatives or the apartment owners, take any liability for theft or damage to personal belongings in the apartment (including those deposited in individual safes), parking garages, storage facilities, or in any other way during the stay.

14.2 Baires Rentals strongly recommends you to cover yourself, every member of your party, your luggage and your party's luggage, cash, jewels, valuables, etc. by a comprehensive travel insurance. Please contact your insurance agent or your travel agent before leaving your residence country.

14.3 The agency shall not be held responsible for the breakdown of mechanical equipment serving the apartment or common to the building, such as water pumps, boilers, lifts, electrical doors, heating systems, neither for the failure of public utilities such as water, natural gas, electricity, etc.

15 - INFORMATION AND PICTURES

15.1 All information supplied by Baires Rentals is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made either in writing or otherwise, but the agency is not liable for any variation however caused.

15.2 It should be emphasized that all information about listed apartments is deemed reliable but not guaranteed. Listed apartments are subject to errors, omissions, change in price, prior sale, rent and withdrawal without notice.

15.3 Photographs, descriptions and information about the properties reflect conditions at the time the photographs were taken.

16 – APPLICABLE LAW

16.1 This agreement (terms and conditions) is governed by the laws of the Autonomous City of Buenos Aires, Argentina. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the local courts.

16.2 All contractual obligations arising out of the apartment rental shall be deemed to come into existence in Buenos Aires, ARGENTINA.

16.3 In these terms and conditions :

16.3.1 The expression `the owner´ shall mean the person(s) who have appointed and authorized Baires Rentals to act as agents;
16.3.2 The expressions `the hirer, the resident, the guest, the tenant and the client´, alternatively, shall mean the person making the booking and all members of the rental party who have been accepted by the agency on behalf of the owner.
